Please read these Terms of Use (“Terms”) carefully. By installing or using the QuickLogger mobile app (“QuickLogger”, the “app”), you agree to these Terms. If you do not agree, do not use the app. QuickLogger is provided by The Fine Group, LLC (doing business as TerraformGanymede) (“Company”, “we”, “us”).
These Terms should be read together with our Privacy Policy.
QuickLogger is an offline-first record-keeping utility that creates log entries — a scanned code, a timestamp, an optional device location, an optional comment, and optional photo/file attachments — attributed to a profile, stored on your device. It does not require an account and does not transmit your data (see the Privacy Policy).
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use QuickLogger on devices you own or control, for your personal or internal record-keeping. You may install the app on multiple devices, but each license key entitles one user to run the app on one device at a time. You may not share your license or license key with others. You may not: (a) copy, resell, sublicense, rent, or commercially redistribute the app; (b) reverse-engineer, decompile, or attempt to derive source code except to the extent that restriction is prohibited by law; (c) remove or alter any notices; or (d) use the app to violate any law or the rights of others.
You are responsible for how you use QuickLogger and for the data you capture, store, share, or export with it — including obtaining any consent required to record locations, images, codes, or other information involving other people or property. Keep your own backups of anything that matters to you; uninstalling the app, clearing the log, or a device failure removes on-device data permanently.
QuickLogger is provided to you “AS IS” and “AS AVAILABLE,” with all faults and without warranties of any kind. To the fullest extent permitted by law, the Company disclaims all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
The Company does not warrant that QuickLogger will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any data it captures, stores, displays, or verifies — including codes, timestamps, locations, photos, files, and log-integrity or verification results — will be accurate, complete, reliable, or preserved. You are responsible for maintaining your own backups of any data that matters to you.
Not for legal, evidentiary, regulatory, or safety-critical use. QuickLogger and its log-integrity, verification, timestamp, and location features are provided for general informational and record-keeping purposes only. They are not guaranteed to be accurate, tamper-proof, admissible, or fit for any legal, evidentiary, compliance, regulatory, forensic, safety-critical, or professional purpose. You are solely responsible for determining whether QuickLogger is suitable for your intended use, and you must not rely on it where accuracy or authenticity is required. The Company is not providing legal, professional, or expert services.
To the fullest extent permitted by law, in no event will the Company, its owners, employees, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of (or inability to use) QuickLogger, even if the Company has been advised of the possibility of such damages and regardless of the legal theory on which the claim is based.
The Company’s total cumulative liability for all claims arising out of or relating to QuickLogger or these Terms will not exceed the greater of (a) the total amount you paid the Company for QuickLogger in the twelve (12) months before the event giving rise to the claim, or (b) US $10.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above exclusions and limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for gross negligence, willful misconduct, fraud, or personal injury or death caused by the Company’s negligence. You agree that these disclaimers and limitations are a fundamental basis of the bargain and that QuickLogger would not be provided without them. These provisions survive termination.
You agree to defend, indemnify, and hold harmless the Company and its owners, officers, employees, contractors, and agents from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use or misuse of QuickLogger; (b) any data, content, images, files, or codes you capture, upload, store, share, or export through the app; (c) your violation of these Terms or of any applicable law or regulation (including privacy, data-protection, or export laws); (d) your infringement or violation of the rights of any third party; and (e) any reliance on, or use of, QuickLogger’s output — including logs, timestamps, locations, and integrity or verification results — for any legal, evidentiary, compliance, or other purpose. The Company may assume the exclusive defense and control of any indemnified matter, in which case you agree to cooperate. This section survives termination.
These Terms, and any dispute or claim arising out of or relating to them or to QuickLogger (including non-contractual disputes), are governed by the laws of the State of Washington, U.S.A., without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The exclusive venue for any dispute will be the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of those courts. If you access QuickLogger from outside the United States, you do so on your own initiative and are responsible for compliance with applicable local laws.
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible or, if it cannot be, severed, and the remaining provisions continue in full force. In particular, any limitation on liability or disclaimer of warranties held unenforceable in part will apply to the greatest extent permitted by law. Our failure to enforce any provision is not a waiver of it.
We may update these Terms; we will update this page and revise the effective date above. Material changes may also be re-surfaced in the app, and continued use after an update means you accept the revised Terms.
